Equinox Technology Fair Use Policy (FUP)

Purpose

This Fair Use Policy (“Policy”) ensures that all Equinox Technology customers receive reliable, high-quality telecommunications and internet services.
It protects our network, complies with FCC and carrier regulations, and prevents activities that could negatively affect other customers or our service infrastructure.

 

Scope

This Policy applies to all Equinox Technology voice, data, messaging, and managed network services, including but not limited to UCaaS, dedicated internet, broadband, SD-WAN, and POTS replacement lines.

 

General Principle

Equinox Technology’s “unlimited” or “flat-rate” plans are designed for normal and reasonable business use.
They are not intended for auto-dialing, continuous call forwarding, call blasting, telemarketing campaigns, or other high-volume activities outside ordinary business communications.

Excessive or abnormal usage patterns may be considered unreasonable and subject to review.

Prohibited or Excessive Uses

Customers may not use Equinox Technology services to:

  • Originate or terminate robocalls, spam, phishing, or spoofed traffic.

  • Transmit unsolicited bulk messages (SMS/MMS) or calls not compliant with 10DLC or toll-free registration requirements.

  • Engage in continuous or automated call bridging, auto-dialing, predictive dialing, or traffic pumping.

  • Use residential or business plans as reseller trunking or carrier bypass.

  • Engage in any illegal, harmful, or fraudulent use of the network.

 

Usage Thresholds and Monitoring

To maintain fair access, Equinox Technology may monitor aggregate usage patterns.
Examples of potentially unreasonable use include (but are not limited to):

  • Call volumes or durations substantially higher than typical business patterns for similar accounts.

  • SMS/MMS volume that exceeds normal operational communication levels.

  • Continuous 24/7 utilization of channels without idle periods.

Equinox does not actively monitor content, only usage metrics required for network stability and regulatory compliance.

Enforcement

If Equinox Technology determines that a Customer’s use violates this Policy, it may:

  1. Notify the Customer and request corrective action.

  2. Temporarily suspend or throttle Services to protect network integrity.

  3. Apply additional usage-based charges, as applicable.

  4. Terminate the affected Services for persistent or severe violations.

Repeated or intentional violations may also be reported to carriers or traceback authorities as required by law.

Legal Compliance

Customers are responsible for complying with all applicable laws and regulations, including:

  • FCC regulations,

  • Telephone Consumer Protection Act (TCPA), and

  • 10DLC and toll-free messaging registration rules.

Non-compliance may result in carrier penalties or service termination.

Changes to This Policy

Equinox Technology may modify this Policy from time to time.
Updates become effective upon posting to this page, and Customers will be notified of material changes via email or invoice notice.
